Applicable legislation, regulations and by-laws
There are many Acts from National and Provincial Governments, as well as Regulations, Standards and By-Laws which has a bearing on the planning, construction and operation of a building (most documents are available on the internet). The Architect, Town Planner, or other Specialists, if required, will inform you of the applicable regulations and the interpretation of them.
You must be aware of the following which will influence the planning of your project:
- National Building Regulations and Building Standards Act (Act 103 of 1977 as amended in 2008).
- SANS 10400 – Code of Practice for the Application of the National Building Regulations (SANS 10400: 1990 and amendments).
- National Heritage Resource Act (Act 25 of 1990).
- Environmental Conservation and Environmental Management Act (Act 107 of 1998).
- The Occupational Health and Safety Act (Act 85 of 1993 and amendments).
- Local Municipal By-Laws – ensure to refer to the latest revisions.
- Estate Rules and Architectural Guidelines, or conditions laid down by a Community Forum.
